Investor Stream 188B

About this Visa:

 This is a 4 years 3 months provisional residence visa;
 Allows you to come to Australia with your family;
 Invest in Australia and you can do business as well;
 Keep the investment in Govt. Bond for 4 years and then;
 Apply for Permanent Residency (PR) in Australia.

Specific Requirements for 188B:
1. Main Applicant under 55 years of age. Some exceptions; and
2. One year experience out of recent 5 years of either;
A. Minimum 10% ownership in qualifying business with a management role; OR
B. AUD 1,500,000 Mil Investment Management Experience; and
3. Net Asset (personal and business) to be AUD 2,250,000 or more; and
4. Must have at least 3 years of Qualifying Business or Investment Management Experience; and
5. MUST Score at least 65 points on the Innovation Points test.

Mandatory Point test Criteria:
1. Age
2. Net Asset
3. Special Endorsement from State Govt
4. Business Turnover
5. Investment Experience

Optional / Additional Points for:
1. Education
2. English / IELTS

Significant Investor Stream 188C

About this Visa:
This is a 4 years 3 months provisional residence visa that allows you to live, invest and do business in Australia. Your family members can be included and kids can study. You get this visa based on your AUD 5 Million investment to Australia (see requirements).The investment needs to be in specified format and you must have a genuine intention to hold this investment for 4 years. After 4 years and meeting other criteria, you will become eligible to apply Permanent Residency (PR).

Can I apply in Australia or overseas?
You can either be in Australia or overseas when we lodge your application. To apply in Australia you must have other substantive visa or in Bridging A, B or C Visa.

Basic Requirements (188C):
For grant of the visa, applicants must make an investment of at least AUD 5 million in a “complying investment”. A “complying investment” for the purposes of the Significant Investor Visa must be made up of:
• At least $500,000 in venture capital and growth private equity funds which invest in start-ups and small private companies
• At least $1.5 million in approved managed funds investing in emerging companies listed on the Australian Stock Exchange.
• A ‘balancing investment’ of up to $3 million in managed funds that may invest in a range of assets, including ASX-listed companies, Australian corporate bonds or notes, annuities and commercial real estate. In this stream, you need to stay at least 6 weeks (40 days) in Australia per year; OR Your spouse needs to stay at least 180 days per year in Australia.

Business Innovation and Investment  (Entrepreneur stream) visa 188E

Eligibility:

• Be under 55 years of age, although a state or territory can waive this requirement if your proposed complying entrepreneur activity will be of exceptional economic benefit to the nominating state or territory
• Have competent English and be able to provide evidence of this at the time you are invited to apply for the visa
• Be undertaking or proposing to undertake a complying entrepreneur activity in Australia and have a genuine intention to continue this activity

An activity is a complying entrepreneur activity if all of the following requirements are met:

• Applicant has one or more legally enforceable agreements to receive funding with a total of at least AUD200 000 from one of the following entities:
• Commonwealth Government agency
• State or Territory Government
• Publicly Funded Research Organization
• Investor registered as an Australian Venture Capital Limited Partnership or Early State Venture Capital Limited Partnership
• Specified Higher Education Provider

• under the agreement at least 10 per cent of the funding must be payable to the entrepreneurial entity within 12 months of the day the activity starts to be undertaken in Australia;
• You held at least 30 per cent interest in your entrepreneurial entity when you entered into the agreement.
• You have a business plan for the entrepreneurial entity noting how your innovative idea will lead to the commercialization of a product or service in Australia, or the development of an enterprise or business in Australia.

This visa lets you:

At first you will get 4 years visa, then establish a new or develop an existing business and/or invest in Australia, make a designated investment with an Australian state or territory government, make and maintain complying investments in Australia or participate in a complying entrepreneurial activity in Australia.

• Travel in and out of Australia for the life of your visa.
• Bring members of your family unit with you to Australia.

Business Talent Migration to Australia (Direct PR) 132

About this Visa:
This category is Permanent Residency (for life time) that allows you and full family to live in Australia for life time. You and full family, gets all benefit of Australian PR, other than voting right. Once you operate business in Australia and meet stay requirements, you become Citizen of Australia and get Australian Passport. Whoever of family members stay, they get citizenship and other stay as PR for life time until they stay in future and become citizen.

Can I apply in Australia or overseas?
You can either be in Australia or overseas when we lodge your application. To apply in Australia you must have other substantive visa or in Bridging A, B or C Visa.

Business Talent Visa is available in two streams:

1. Significant Business History Stream: for people with large scale business ownership and experience.
2. Venture Capital Entrepreneur Stream: for people who have access to venture capital funding of at least AUD 1 million.

Basic Requirements (132):

Common Criteria
All applicants must have a genuine and realistic commitment to either establish a new business or to participate in an existing business, and to maintain substantial ownership interest, and be involved in the day to day management of the business.

Significant Business History Stream
For the Significant Business History Stream, you would need to meet the following criteria:
1. Main applicant under 55 years of age. If you are 55 years or more, some state may accept your application under exceptional economic benefit; and
2. Net Asset Personal and Business assets (Applicant + Spouse) to be AUD 1,500,000 ; and
3. Main applicant have a overall successful business career; and
4. You and or your partner must have at least AUD 400,000 net asset in one or 2 qualifying businesses; and
5. Annual turnover of at least AUD 3,000,000 for the 2 years in recent 4 fiscal years from maximum 2 qualifying business; and
6. Qualifying Business – Main applicant (only) MUST have any one of bellow for 2 fiscal years;
o Minimum 51% Share if turnover is less than AUD 400,000 per year; OR
o Minimum 30% Share if turnover is more than AUD 400,000 per year; OR
o Minimum 10% Share if Public Listed Company.

Venture Capital Entrepreneur Stream
For the Venture Capital Entrepreneur Stream, you must have a venture capital funding agreement of at least AUD 1 million through an Australian company who is a member of the Australian Venture Capital Association Limited (AVCAL).
